{"id":23037,"date":"2024-08-12T10:32:00","date_gmt":"2024-08-12T08:32:00","guid":{"rendered":"https:\/\/www.eures.sk\/posting-of-workers-to-slovakia\/"},"modified":"2026-02-04T07:39:44","modified_gmt":"2026-02-04T06:39:44","slug":"posting-of-workers-to-slovakia","status":"publish","type":"post","link":"https:\/\/www.eures.sk\/en\/posting-of-workers-to-slovakia\/","title":{"rendered":"Posting of workers to Slovakia"},"content":{"rendered":"\n<p>The posting of workers shall be carried out in accordance with the Directives <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/ALL\/?uri=CELEX%3A31996L0071\" target=\"_blank\" rel=\"noreferrer noopener\">96\/71\/EU<\/a>, <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex%3A32014L0067\" target=\"_blank\" rel=\"noreferrer noopener\">2014\/67\/EU<\/a> and <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=celex:32018L0957\" target=\"_blank\" rel=\"noreferrer noopener\">2018\/957\/EU<\/a>, the purpose of which is <strong>to ensure fair labour mobility in the internal market<\/strong>. This legislation is intended to help workers, employers and national authorities understand the rules for posting workers &#8211; workers should be aware of their rights and national authorities and employers should apply these rules correctly and uniformly throughout the EU.<br><br><strong>We speak of the posting of workers<\/strong> when the company is in one of the following situations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>on the basis of a concluded trade agreement, the company will provide its services in another EU country, we talk about <strong>&#8220;posting on the basis of a contract for the provision of services&#8221;<\/strong><\/li>\n\n\n\n<li>workers are posted to an establishment or undertaking owned by the same group in the territory of another Member State, we speak of <strong>&#8220;intra-group postings&#8221;<\/strong><\/li>\n\n\n\n<li>it is a temporary employer or an intermediary agency which intends to hire a worker to a user undertaking in the territory of another Member State, we speak of a <strong>&#8220;temporary agency posting&#8221;<\/strong><\/li>\n<\/ul>\n\n\n\n<p>In each of the above cases, the posting can be carried out for a limited period of time and the worker must be in an employment relationship with the employer at all times.<\/p>\n\n\n\n<p><strong>Who may be a posted worker?<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>An EU \/ EEA or Swiss national, or<\/li>\n\n\n\n<li>a third-country national who is legally resident and employed in the territory of the posting Member State.<\/li>\n<\/ul>\n\n\n\n<p>If you are considering posting your employees to Slovakia, you will be a &#8220;host employer&#8221; in our territory, who must fulfill the notification obligation, ideally before the posting &#8211; the <strong>national contact point is the <a href=\"https:\/\/www.ip.gov.sk\/posting-of-workers\/\" target=\"_blank\" rel=\"noreferrer noopener\">National Labour Inspectorate<\/a><\/strong>.<\/p>\n\n\n\n<p>The company in which your employees will work as posted workers in Slovakia has a so-called \u201cinformation obligation\u201d towards the Office of Labor, Social Affairs and Family at the place of work of posted workers. This obligation includes the submission of the <a href=\"https:\/\/www.upsvr.gov.sk\/sluzby-zamestnanosti\/zamestnavanie-cudzincov\/zamestnavanie-obcanov-eu-ehp.html?page_id=272203\" target=\"_blank\" rel=\"noreferrer noopener\">Information Card, Annex no.8<\/a> in case of EU \/ EEA or Swiss citizens, and the <a href=\"https:\/\/www.upsvr.gov.sk\/sluzby-zamestnanosti\/zamestnavanie-cudzincov\/4.-zamestnanie-statneho-prislusnika-tretej-krajiny-u-ktoreho-sa-povolenie-na-zamestnanie-ani-potvrdenie-o-moznosti-obsadenia-vpm-nevyzaduje-v-pripade-pismena-f-od-1.1.2020.html?page_id=363584\" target=\"_blank\" rel=\"noreferrer noopener\">Information Card, Annex no.9<\/a> in case of third-country nationals.
