Hiring Foreigners
Legal duties of a foreigner who is not a citizen of the EU/EEA country and is interested to work in Slovakia:
§ Work permit – to be issued by a relevant office of labour, social and family affairs with respect to a place of job
§ Residence permit – to be issued by a department of Foreign Police of the Police Forces

Work Permit
Foreigner applies for work permit himself/herself or through his/her future employer using a work permit application form

Documents necessary for issuance of work permit

  • 1 copy of job vacancy announcement
  • 1 copies of work permit application forms (employment) or 4 original copies (sent out for a job)
  • 1 copy of company’s reasoning why company wants to hire foreigner
  • Official certified document of foreigner’s education – translated to Slovak by a translator
  • If foreigner is sent out by employer to Slovakia – an original copy of job contract - translated to Slovak by a translator
  • Certificate of incorporation of a company or trade license (an original copy or certified copy not older than 3 months)
  • If foreigner wants employer to submit the application he/she must supply the application with his/her written consent with such an application filing procedure, i.e. to certify authenticity of signature at a public notary

Permit Validity

  • Not more than 2 years with an option of prolonging
  • Not more than 6 months – for seasonal jobs

Prolonging Permits

  • A written application filed by foreigner not later than 30 days before the permit expiry
  • Job will be done with the same employer
  • Employer’s statement that it will continue to employ the foreigner

A period for work permit issuance is 30 days after the application delivery.

Work permit is non-transferable!

 

Legal duties of employers for foreigners who are not required to have work permit

  • To employ a person in compliance with the Labour Code
  • To register employee at a relevant office of labour, social & family affairs with respect to a place of job not later than 7 business days using a form „Information Card“
  • To register employee at a branch of the Social Agency before starting a job
  • To register the employee at a health insurance company within 8 business days
  • To deregister the employee from all institutions after terminating his/her job.
